01Acceptance of Terms

By accessing or using the ClearCost platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update or change these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.

02Description of Service

ClearCost provides AI-powered bill analysis, dispute preparation, and negotiation services for utility bills, service contracts, and other financial documents. The Service includes:

• Document upload and AI-powered analysis for errors, overcharges, and red flags
• Preparation of dispute letters and negotiation packages
• Direct negotiation with service providers on your behalf
• Flat-fee review reports for document analysis without negotiation
• Dashboard access to track the status of ongoing negotiations
• Backed by Real Humans

The Service does not constitute legal advice. For matters requiring legal counsel, you should consult a licensed attorney.

03Fees and Payment

Our fee structure is based on the type of document negotiated:

• Utilities & Subscriptions: 20% of verified savings
• Contracts & Service: 30% of verified savings
• Review-only report (no negotiation): flat fee of $4.99

Success fees are only charged after savings have been verified and you have confirmed the outcome.

No savings means no fee.

Flat-fee review reports are charged at the time of order.

All fees are in US Dollars.

We reserve the right to modify our fee structure with reasonable notice.

Fees for ongoing cases at the time of a change will not be retroactively altered.

04User Responsibilities

By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal right and authority to submit the documents you upload
• All information you provide is accurate and complete to the best of your knowledge
• You will not use the Service for any fraudulent, unlawful, or abusive purpose
• You will not upload documents belonging to others without proper authorization
• You understand that the Service cannot guarantee specific negotiation outcomes

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

05Data Privacy and Security

We take the security of your data seriously. All uploaded documents and personal information are encrypted in transit using TLS and at rest using AES-256 encryption. Your data is processed in isolated environments and is never sold to third parties.

We share your information only to the extent necessary to perform the negotiation service — for example, with the provider or institution whose bill you have submitted for dispute. All such sharing is done in accordance with our Privacy Policy.

Documents are deleted from our servers upon case closure unless you request otherwise in writing. Please refer to our Privacy Policy for full details on data collection, use, and retention.

06No Guarantee of Outcome

While our AI and negotiation process achieve savings in a majority of cases, we do not guarantee any specific result. Outcomes depend on the specific provider, the nature of the bill or contract, applicable regulations, and other factors outside our control.

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.

07Limitation of Liability

To the maximum extent permitted by law, ClearCost and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.

08Intellectual Property

All content, technology, software, trademarks, and materials provided by ClearCost are the exclusive property of the company and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without express written permission.

By uploading documents to the Service, you grant us a limited, non-exclusive, royalty-free license to process and analyze those documents solely for the purpose of providing the Service to you.

09Cancellation and Termination

You may cancel a pending negotiation at any time before a settlement is reached, at no cost. You may also close your account at any time by contacting support or using the account settings page.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or harmful activity.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including payment obligations, limitation of liability, and dispute resolution) will remain in effect.

10Exclusivity of Negotiation Services

Upon requesting or authorizing negotiation services, the client agrees that ClearCost shall have the exclusive right to negotiate the applicable bill, invoice, or contract on the client's behalf. The client shall not, directly or indirectly, initiate, continue, or engage in independent negotiations regarding the same matter during the term of the engagement.

If the client breaches this provision and obtains or attempts to obtain savings independently after initiating services with ClearCost, such actions shall be deemed a material breach of this agreement. In such cases, ClearCost reserves the right to recover its applicable success fee (20–30%) based on the total savings identified or achieved, in addition to any other remedies permitted by law.

11Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.

If informal resolution is unsuccessful, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for any alleged infringement of intellectual property rights.

You agree to waive any right to a jury trial or to participate in a class action lawsuit against ClearCost.

12Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page and, where appropriate, notify you by email or via a notice on the Service. Your continued use of the Service after the effective date of any change constitutes your agreement to the updated Terms.
